Welcome to Fluo, a mobile application developed by LinguaTech ("we", "us", or "our"). These Terms of Service ("Terms") govern your use of the Fluo mobile application and associated services (collectively, the "App"). By accessing or using the App, you agree to these Terms. If you do not agree, do not use the App.

1. Purpose

These Terms define the rights and obligations between LinguaTech and users ("you") regarding the use of the Fluo language learning app and its services across mobile platforms.

2. Definitions

App: The Fluo application and its related services.

User: Any person who accesses or uses the App.

Account: The profile and credentials used to access the App.

Content: All exercises, features, and media provided by the App. This includes embedded YouTube videos, which remain the intellectual property of their respective creators.

Subscription: A paid plan that grants access to premium features within the App.

User Content: Any data or media submitted by users within the App.

3. Acceptance of Terms

By using the App, you accept these Terms and our Privacy Policy. If you do not agree, you must discontinue use immediately.

4. Interpretation of Terms

If any conflict arises between these Terms and specific feature or promotion terms, the latter shall prevail. Matters not covered will follow applicable law and standard business practice.

5. Account Registration and Use

You may explore limited features of the App without creating an account ("Guest Mode"). Guest Mode provides restricted access to content and functionality. To unlock the full experience — including progress tracking, subscriptions, and personalised features — you must create an account. You agree to provide accurate, current, and complete information during registration and to maintain its accuracy. We reserve the right to suspend or terminate your access for violations of these Terms or fraudulent activity.

6. Account Security

You are responsible for keeping your login credentials confidential. If you believe your account has been compromised, notify us at contact@linguatech.app. We are not responsible for losses from unauthorized use unless due to our negligence.

7. Service Features

Fluo provides:

  • Listening: Dictation exercises and comprehension quizzes using video content
  • Speaking: AI role-play conversations for pronunciation and fluency practice
  • Learning Path: Structured grammar and vocabulary lessons, plus an AI Tutor chat for personalised guidance
  • Progress tracking and learning recommendations
  • Language practice content — currently English (for Spanish and Portuguese speakers)
  • Free access includes a limited number of daily activities across Speaking, Listening, and Learning modules. Specific limits may vary. New users receive a more generous allowance during their first week. Full content access is available to subscribers.

We may modify features or the availability of the App at any time without liability.

8. Service Modifications

We may update, suspend, or discontinue features for technical, operational, or business reasons. No compensation is owed for such modifications unless otherwise stated.

9. Notifications

We may send you notices via the App, email, or website. You are responsible for keeping your contact information current. We are not liable for missed notices due to outdated information.

10. Temporary Interruptions

We may interrupt access for maintenance or emergencies. When feasible, we will notify you in advance. We are not liable for losses during such downtime.

11. Termination by User

You may stop using the App or request account deletion at any time. Deleting your account will remove all associated data, which cannot be recovered.

12. Termination by LinguaTech

We may suspend or terminate your access without notice if you:

  • Violate these Terms or laws
  • Use the App fraudulently or abusively
  • Interfere with or disrupt the App or other users

13. Advertising and Third-Party Content

Fluo does not currently display advertising. We may include advertising in future versions of the App. If we do, this section will be updated accordingly.

The App uses embedded videos from YouTube, which are streamed through the official YouTube embedded player in compliance with YouTube's API Services Terms. Fluo does not download, store, or alter any video content from YouTube. All intellectual property rights to such content remain with their respective creators.

By using Fluo, you acknowledge and agree to be bound by:

LinguaTech is not affiliated with, sponsored by, or endorsed by YouTube or Google LLC. The use of YouTube content within the App is solely for educational purposes and adheres to all applicable API usage policies.

14. Our Responsibilities

We will provide the App in a secure, stable, and reliable manner. We take data protection seriously and follow our Privacy Policy. We may respond to support inquiries or complaints at our discretion.

15. User Responsibilities

You agree not to:

  • Reproduce or distribute App content
  • Harass or defame others
  • Scrape, reverse-engineer, or use the App via bots
  • Submit unlawful, offensive, or infringing content

16. User-Generated Content

You may create or submit content within the App (e.g., recordings, feedback). You retain ownership but grant us a license to use such content for improvement or promotional purposes. We may moderate or remove content that violates these Terms.

17. Intellectual Property

All App content and branding are owned by LinguaTech or its licensors. You may not reuse any part of the App without our written permission. YouTube content is owned by its original creators and is used in compliance with YouTube's API Services Terms.

18. Disclaimer and Limitation of Liability

We provide the App "as is." We do not guarantee uninterrupted service, accuracy, or availability. We are not responsible for losses from downtime, user content, or third-party content.

19. AI-Generated Content

Certain features of the App — including conversation practice, feedback, suggestions, and grammar explanations — are generated by artificial intelligence (AI) systems. This content is provided for educational and informational purposes only and does not constitute professional linguistic, academic, or any other form of professional advice.

While we strive for accuracy, AI-generated content may occasionally contain errors or inaccuracies. You should not rely on it as a sole source of information for any critical purpose.

20. Subscriptions and Payments

Subscription transactions are processed by Apple through your App Store account or by Google through your Google Play account. You are responsible for any taxes or fees that may apply in your jurisdiction.

Subscriptions renew automatically for the same period and price unless cancelled at least 24 hours before the end of the current period via your Apple ID settings or Google Play subscription settings.

By confirming a subscription, you authorize Apple or Google to charge the applicable fee to the payment method associated with your account.

21. Right of Withdrawal

If you reside in the European Economic Area (EEA) or the United Kingdom, you have 14 days from the purchase date to withdraw from your subscription without giving any reason.

You can exercise this right by visiting Apple's "Report a Problem" page, Google Play's refund page, or by contacting the respective store's support directly. All refunds are processed exclusively by the store through which the purchase was made; Fluo cannot override their refund decisions.

Users outside the EEA/UK may still request a refund through the same store channels, subject to their regional policies.

22. Mistaken Payments

For mistaken or duplicate payments, contact the store through which the purchase was made. If LinguaTech processes a refund (e.g., for promotional credits), we may deduct applicable transaction fees.

23. Damages and Liability

Each party is responsible for damages caused by breaches of these Terms if intentional or negligent. Our liability is limited to the fullest extent permitted by law.

24. Service Termination

We may shut down the App permanently with 30 days' notice. Features may be restricted during the transition.

25. Governing Law and Jurisdiction

These Terms are governed by the laws of the Republic of Argentina. Any disputes shall be resolved by the courts of Buenos Aires, Argentina.

26. Data Protection

We process personal data in accordance with our Privacy Policy. By using the App, you consent to our handling of your information as described there.
